Avi Bernstein

Avi brings over 25 years of experience advising public and private companies and nonprofit organizations on employee benefits and executive compensation. He helps clients design and manage a wide range of benefit plans, including qualified and nonqualified retirement plans, deferred compensation arrangements, health and welfare benefits, severance programs, and equity-based incentives. His work focuses on reducing legal risk and streamlining plan administration. Clients turn to Avi to structure and negotiate compensation and benefits packages for executives and key employees.

Avi has significant experience advising on IRS Section 409A compliance for nonqualified plans and supports clients through IRS and Department of Labor correction programs when qualification or fiduciary issues arise. In M&A transactions, Avi helps clients assess benefits-related risks, align and consolidate plans, and avoid missteps during post-deal integration.

Avi spent nearly ten years as in-house benefits counsel at a global insurance provider, advising on internal benefit programs and issues involving international staff. Before that, he practiced at an international law firm, where he handled qualified retirement plan matters for single and multiemployer arrangements. He also worked in human resources consulting at a Big Four accounting firm, supporting clients on ERISA compliance and benefits strategy.

Avi holds an LL.M. in Taxation from NYU School of Law, a J.D. from Benjamin N. Cardozo School of Law, and a B.A. in Economics from Yeshiva University.
